Terms of Service

1. Acceptance of Terms

By accessing or using the Aurexum platform, website, applications, APIs (if made available), and any associated services (collectively, the “Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms in full, you must not access or use the Service.

These Terms constitute a legally binding agreement between you and the operator of Aurexum (“Aurexum,” “Company,” “we,” “us,” or “our”). Aurexum is operated from Australia. By using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated by reference.

You represent that you are at least 18 years of age (or the age of legal majority in your jurisdiction, if higher) and have the legal capacity to enter into this agreement. If you use the Service on behalf of an organisation, you represent that you have authority to bind that organisation, and “you” includes that organisation.

We may modify these Terms at any time. Where changes are material, we will take reasonable steps to notify you (for example, by updating the date above or by in-Service notice). Your continued use of the Service after the effective date of revised Terms constitutes acceptance of those Terms.

2. Nature of the Service

Aurexum is an informational fragrance price comparison and market analytics platform. The Service aggregates, organises, and displays pricing and related product information sourced from publicly available or licensed third-party data. Features may include search and filtering, price history charts, deals listings, Note Finder and scent-matching tools, watchlists, price alerts, retailer directories, community retailer ratings, blog content, and similar discovery tools.

Aurexum is not a retailer, marketplace, broker, payment agent, logistics provider, or fulfilment service. We do not sell, distribute, warehouse, ship, authenticate, inspect, or take title to any fragrance or other product. We do not process payments for third-party goods, negotiate purchases on your behalf, or guarantee that any listing shown on the Service remains available, correctly priced, or lawfully offered.

All information on the Service is provided for general informational and comparison purposes only. It does not constitute legal, financial, tax, customs, product-safety, medical, or professional advice. You are solely responsible for evaluating any product, retailer, or transaction before you buy.

3. Third-Party Retailers & Your Purchases

When you follow a link from the Service to a third-party retailer's website (“Outbound Link”), you leave Aurexum and enter a separate relationship with that retailer. Your purchase, payment, delivery, returns, warranties, and disputes are governed exclusively by that retailer's terms, policies, and applicable law—not by these Terms.

3.1 No responsibility for retailer conduct

To the fullest extent permitted by law, Aurexum disclaims all liability for any act, omission, or failure of any third-party retailer, including but not limited to:

  • Fraud, scams, and misrepresentation: counterfeit or replica products, bait-and-switch listings, fake discounts, stolen payment credentials, phishing, impersonation, or any fraudulent or deceptive trade practice by a retailer or third party.
  • Order fulfilment: late, partial, or non-delivery; lost or damaged shipments; incorrect items; failure to ship; warehouse errors; or carrier and logistics failures.
  • Returns, refunds, and chargebacks: refusal or delay of returns; restocking fees; store credit instead of refunds; disputed chargebacks; or any policy applied by the retailer that differs from what you expected.
  • Product quality and authenticity: product condition, batch variation, reformulation, expiry, allergens, regulatory compliance, or whether goods are genuine, grey-market, parallel import, or counterfeit.
  • Pricing and checkout: prices, shipping fees, duties, taxes, coupons, or promotions at checkout that differ from what we display; currency conversion applied by the retailer; payment failures; or declined transactions.
  • Customer service: unresponsive support, account lockouts, order cancellations initiated by the retailer, or any dispute between you and the retailer.
  • Legal and regulatory matters: import restrictions, quarantine, customs seizures, excise or GST treatment, product registration, or purchase prohibitions in your jurisdiction.

Listing a retailer on the Service, linking to a retailer, displaying a price, or showing a community rating does not constitute our endorsement, recommendation, warranty, or verification of that retailer's legitimacy, solvency, licensing, or business practices. You assume all risk in selecting where to shop.

3.2 Your remedies lie with the retailer

If you experience any problem with a purchase, you must pursue remedies directly against the retailer and/or your payment provider. Aurexum is not a party to your transaction and has no obligation to intervene, mediate, refund, replace goods, or compensate you for retailer-related losses.

We may, at our sole discretion and without assuming any liability, remove or delist retailers from the Service based on credible reports of misconduct. Such action does not imply prior knowledge, admission of fault, or an ongoing duty to police third-party conduct.

4. Data Accuracy, Currency & Availability

Pricing, stock, shipping destinations, product images, concentration, bottle size, and other data on the Service are obtained from automated scans, third-party feeds, manual curation, and user submissions. This data may be delayed, incomplete, outdated, or erroneous.

Without limiting any other disclaimer in these Terms, we do not warrant that:

  • displayed prices match the retailer's live checkout price;
  • a product is in stock or available for purchase;
  • a retailer ships to your country or region;
  • currency conversions (including live exchange rates) are accurate for your transaction;
  • price history charts, deal badges, or “lowest price” indicators are error-free; or
  • Note Finder, scent-matching, or discovery results will suit your preferences or skin chemistry.

You must independently verify all material facts on the retailer's website before completing any purchase. Reliance on Service data is at your own risk.

5. User Accounts

Certain features (including watchlists, price alerts, profile preferences, and any paid plans if offered) require registration. You agree to provide accurate, current, and complete information and to maintain the security of your credentials. You are responsible for all activity under your account.

Notify us promptly of any unauthorised access. We may suspend or terminate accounts at our discretion, including for suspected violations of these Terms, abusive behaviour, or risk to the Service or other users. We are not liable for loss of account data, saved watchlists, or alert history following suspension, termination, or technical failure, except where non-excludable under applicable law.

6. Price Alerts, Notifications & Communications

Price alerts, email notifications, and similar features are provided on a best-efforts basis. We do not guarantee delivery, timeliness, frequency, or accuracy of alerts. Alerts may be delayed or fail due to scanning intervals, retailer site changes, email filtering, provider outages, or system maintenance.

A triggered alert does not guarantee that a price will remain available, that you will complete a purchase in time, or that the underlying listing is legitimate. You are responsible for acting on alerts and verifying prices before purchase. We are not liable for missed deals, duplicate notifications, or losses arising from alert failures or delays.

7. User Content & Community Features

The Service may allow you to submit retailer suggestions, ratings, reviews, feedback, bug reports, or other content (“User Content”). You retain ownership of your User Content, but grant us a worldwide, non-exclusive, royalty-free, perpetual licence to use, reproduce, modify, adapt, publish, and display it in connection with operating and improving the Service.

You represent that your User Content is truthful to the best of your knowledge, does not violate any third-party rights, and complies with applicable law. Community retailer ratings reflect subjective user opinions only—they are not verified statements of fact by Aurexum. We may moderate or remove User Content at any time without notice and without liability.

8. Permitted Use & Restrictions

We grant you a limited, revocable, non-exclusive, non-transferable licence to access and use the Service for personal, non-commercial purposes (unless otherwise agreed in writing). You must not:

  • scrape, harvest, or systematically extract data from the Service without written consent;
  • use bots, crawlers, or automated means to overload or circumvent access controls;
  • reverse engineer, decompile, or attempt to derive source code except where permitted by law;
  • circumvent rate limits, authentication, or security measures;
  • resell, sublicense, or commercially exploit Service data or access;
  • upload malware, interfere with Service integrity, or impersonate others;
  • use the Service for unlawful purposes or in violation of applicable regulations; or
  • submit false retailer ratings, fraudulent reports, or misleading User Content.

We may investigate violations and cooperate with law enforcement. Breach of this section may result in immediate termination and pursuit of available remedies.

9. Intellectual Property

The Service, including its design, software, databases, compilations, charts, logos, and original content, is owned by Aurexum or its licensors and protected by copyright, trade mark, and other intellectual property laws. Except for the limited licence above, no rights are granted to you.

Fragrance names, brand names, and trade marks displayed on the Service belong to their respective owners. Their use is for identification and comparison only and does not imply affiliation or endorsement.

If you believe content on the Service infringes your intellectual property rights, contact us via the contact page with sufficient detail for us to assess your claim. We may remove or disable access to allegedly infringing material in appropriate circumstances.

10. Affiliate & Commercial Relationships

Aurexum may receive commissions, referral fees, advertising revenue, or other compensation from retailers or partners when you use Outbound Links or interact with sponsored placements. Such relationships do not change our status as an information provider: we do not guarantee any retailer, and commercial arrangements do not constitute a warranty of retailer performance.

Where required by law, we will disclose material commercial relationships. Display order, prominence, or featured placement may be influenced by commercial factors in addition to price or relevance.

11. Paid Features & Subscriptions

Core browsing and comparison features are currently offered without charge. If we introduce paid plans, subscriptions, or premium features, separate pricing and billing terms will apply. By subscribing, you authorise us and our payment processor (e.g. Stripe) to charge applicable fees. Subscription fees are generally non-refundable except where required by law or expressly stated at purchase.

We may change pricing or features on reasonable notice. You are responsible for cancelling before renewal if you do not wish to continue. Failure to pay may result in suspension of paid features without affecting these Terms' disclaimers and limitations.

12. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICE AND ALL CONTENT, DATA, AND FUNCTIONALITY ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, ACCURACY, NON-INFRINGEMENT, AND UNINTERRUPTED OR ERROR-FREE OPERATION.

We do not warrant that the Service will meet your requirements, that defects will be corrected, that the Service or servers are free of viruses or harmful components, or that Outbound Links lead to safe or legitimate destinations. Any material downloaded or obtained through the Service is at your sole risk.

Some jurisdictions do not allow exclusion of implied warranties. In those cases, the above exclusions apply only to the extent permitted by law.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, AUREXUM AND ITS DIRECTORS, OFFICERS, EMPLOYEES, CONTRACTORS, AND AGENTS SHALL NOT BE LIABLE FOR ANY:

  • indirect, incidental, special, consequential, or punitive damages;
  • loss of profits, revenue, data, goodwill, or anticipated savings;
  • cost of substitute goods or services;
  • damages arising from third-party retailers, products, shipping, fraud, or transactions;
  • damages arising from reliance on pricing, alerts, charts, ratings, Note Finder results, or other Service data; or
  • damages arising from unauthorised access to your account, security incidents, or Service interruption,

WHETHER ARISING IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STATUTE, EQUITY, OR OTHERWISE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Where liability cannot be excluded, our total aggregate liability to you for all claims arising out of or relating to the Service or these Terms is limited to the greater of: (a) AUD $100; or (b) the total amounts you paid to Aurexum for the Service in the twelve (12) months before the event giving rise to the claim (if any).

Nothing in this section limits liability that cannot be limited under the Australian Consumer Law or other non-excludable rights (see Section 14).

14. Australian Consumer Law

Our Service is supplied to consumers within the meaning of the Australian Consumer Law (ACL) contained in Schedule 2 of the Competition and Consumer Act 2010 (Cth). Nothing in these Terms excludes, restricts, or modifies any guarantee, right, or remedy under the ACL (or any similar non-excludable consumer protection law) that cannot lawfully be excluded.

To the extent our Service is not of acceptable quality or does not match descriptions required under applicable consumer law, your remedies may include repair, resupply, refund, or compensation as provided by law. Where we are permitted to limit liability for a non-excludable failure, our liability is limited (at our option) to resupplying the Service or paying the cost of having the Service supplied again.

15. Indemnification

You agree to indemnify, defend, and hold harmless Aurexum and its personnel from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to: (a) your use of the Service; (b) your User Content; (c) your violation of these Terms or applicable law; (d) your dealings with third-party retailers; or (e) any dispute between you and a third party in connection with products or services you purchased after using the Service.

We may assume exclusive defence and control of any matter subject to indemnification by you, and you agree to cooperate with our defence. This section does not apply to the extent prohibited by law.

16. Release

To the fullest extent permitted by law, you release Aurexum from any and all claims, demands, and damages (actual and consequential) of every kind and nature, known and unknown, arising out of or in any way connected with disputes with third-party retailers, product defects, delivery failures, payment disputes, or fraudulent conduct by third parties. If you are a consumer in a jurisdiction that does not allow broad releases, this section applies only to the extent permitted.

17. Force Majeure

We are not liable for any failure or delay in performing obligations under these Terms where caused by events beyond our reasonable control, including natural disasters, war, terrorism, labour disputes, government action, internet or hosting failures, retailer site changes, third-party API outages, cyber attacks, or pandemics.

18. Termination

We may suspend or terminate your access to the Service at any time, with or without cause or notice. Upon termination, your licence ends immediately. Provisions that by their nature should survive (including Sections 3, 9, 12–16, 19–22, and 24) remain in effect.

19. Dispute Resolution

Before commencing formal proceedings, you agree to contact us via the contact page and attempt in good faith to resolve the dispute within thirty (30) days. Nothing in this section prevents either party from seeking urgent injunctive relief or exercising non-excludable statutory rights.

20. Governing Law & Jurisdiction

These Terms are governed by the laws of Australia, including the ACL and other mandatory consumer laws that apply in your State or Territory. You agree that the courts of Australia have non-exclusive jurisdiction to resolve disputes arising from or relating to these Terms or the Service, and you submit to the jurisdiction of those courts.

If you access the Service from outside Australia, you do so on your own initiative and are responsible for compliance with local laws. Mandatory consumer protections in your country of residence may still apply where they cannot be contracted out.

21. General Provisions

Entire agreement: These Terms, together with the Privacy Policy and Cookie Policy, constitute the entire agreement between you and Aurexum regarding the Service, superseding prior understandings on the same subject.

Severability: If any provision is held invalid or unenforceable, the remaining provisions remain in full force, and the invalid provision will be modified to the minimum extent necessary to make it valid.

No waiver: Failure to enforce any right is not a waiver of that right.

Assignment: You may not assign these Terms without our consent. We may assign our rights and obligations without restriction in connection with a merger, acquisition, or sale of assets.

22. Changes to These Terms

We may update these Terms from time to time. Material changes will be reflected by updating the “Last updated” date and, where appropriate, additional notice within the Service. Your continued use after changes take effect constitutes acceptance.
